The clerk shall submit the fingerprints, photograph, and any other identifying information to the Federal Bureau of Investigation or the state or local police department from which the information was taken for entry in the appropriate database. The clerk shall send a copy of the application, photographs, and fingerprints to the chief law-enforcement officer of the local government and to the chief law-enforcement officer of the city in which the applicant resides. The clerk shall send a copy of the application, fingerprints, and photograph to the firearms licensing board of the county or city in which the applicant resides, or to the local mental health board if an application for a mental health permit is required by 18.2-240. This information shall be retained in the local law-enforcement database for a period of at least five years, as prescribed by regulation of the Firearms Licensing Board, and for a period of five years thereafter. If the clerk has not received fingerprint identification information from a law-enforcement agency of the county in which the applicant resides, but has received fingerprint identification information from a law-enforcement agency of another county, the clerk shall submit the fingerprint identification information to the appropriate law-enforcement agency in the other county, including fingerprints taken by local police officers upon arrest pursuant to 19.2-390 and information identifying the county from which the fingerprint identification information was received.
D. The Commonwealth shall be immune from any liability arising from the failure to enforce this section and shall have no responsibility for the establishment of photo identification programs in accordance with this section or the establishment of photo identification programs for motorists.
